Related Information:Defective Construction ClaimsMaslon has developed a niche practice relating to the representation of contractors whose work is alleged to be defective, particularly complex building systems like opacifier failures within steel and glass curtain wall systems; EIFS exterior wall failures; various and numerous roofing systems; HVAC systems, including variable air volume and constant air volume distribution systems; false work failures; window construction and installation failures; and building foundation failures. We are commonly called upon to enforce insurance contracts on behalf of contractors whose carriers have declined coverage for defective construction claims. One of our lawyers has written extensively in this area, and is called upon often to litigate insurance coverage disputes for contractors across the United States. Most recently the South Carolina Court of Appeals, in a case in which we were not involved, rejected a carrier's declination, reasoning that a contrary model was the favored approach to resolving construction coverage issues involving defective construction.
