Defending Employers

Overview

You can't always prevent a lawsuit. If it happens, Maslon will represent you aggressively and efficiently. We'll help you develop the most effective and cost-efficient strategy, remembering that resolving litigation early, through mediation or other alternative means, is sometimes the best strategy. If the best strategy is trial, we vigorously advance your position in court, where we have succeeded in obtaining dismissal of claims before trial, and have tried cases successfully to favorable judgments.

We regularly represent employers in agency proceedings, such as the Equal Employment Opportunity Commission, the Minnesota Department of Human Rights, and other federal and state administrative agencies, with respect to charges of discrimination and violation of employment laws. Many of these charges have resulted in "no probable cause" determinations. Where appropriate, we have worked through the agency to secure a prompt and efficient resolution of the dispute. We also defend employers in federal and state courts throughout the country in employment contract and statutory claims, claims of sexual harassment, and all types of discrimination claims, including allegations of race, national origin, age, religious, sexual orientation and disability discrimination cases involving AIDS, cancer, back problems, mental conditions and repetitive motion injuries. We have extensive experience handling sensitive internal investigations for employers where misconduct is alleged or suspected, including embezzlement, theft, sexual harassment, and employee drug use and sales.

The breadth of our experience spans the following areas:

  • Discrimination and Harassment Claims
  • Wage and Hour Claims
  • Whistleblower and Retaliation Claims
  • Contractual Claims, Wrongful Termination and Other Workplace Claims
  • Agency Proceedings (EEOC, State and Local Human Rights Agencies)
  • Qui Tam Litigation
  • Non-Competition and Trade Secrets
  • Employment Issues in Shareholder Litigation
