Environmental Due Diligence

Overview

Environmental due diligence is an essential part of acquiring or financing any real property for the buyer and the lender. We work closely with our clients to negotiate the transaction or loan documents to ensure that the rights and requirements of our clients are fully addressed by the due diligence provisions in the documents. As part of our standard review of a Phase I report, we review historical uses and consider the potential future uses and redevelopment of urban real estate, brownfields or other industrial properties.

If necessary, we recommend Phase II reports and work with the client, the Minneapolis Pollution Control Agency, the Department of Natural Resources, or other government agencies to limit our client's liability for pre-existing environmental conditions, and to assess the corresponding associated risk. Maslon employs a positive and creative approach to finding favorable solutions to potential environmental issues. We can also advise a purchaser or lender on the risks associated with any environmental issues.
