David Schultz's Commentary on Death Row Defenses Featured in Minnesota Lawyer

David Schultz, a member of Maslon's Litigation Group, was featured in the Minnesota Lawyer article titled, "Death Row Defenses." The article, which appears in the October 5, 2009 issue, examines the fact that even though Minnesota doesn't have capital punishment, there has been an impressive response from Minnesota attorneys willing to offer their services on a pro bono basis to inmates with death sentences. The article reports that local lawyers agree to take on these cases, "because they care about justice, which is lacking in most death penalty cases."

"Death penalty cases are so hard and so taxing and the stakes are so high that a lot of time the cases don't get the attention they deserve and defendants don't get the representation they need," said Schultz, who is currently working on his second death penalty case. "Whatever your views of the death penalty, it's not something we should impose unless and until the defendant has had a full and fair opportunity to have representation."
