Greenacres / Agricultural Conservation Programs
Overview
Maslon represents rural and agricultural property owners with issues relating to the "greenacres statute" - which requires deferment of certain property taxes for agricultural property - including qualification for the greenacres program, "recapture" of real estate taxes upon disqualification of property taken out of the program, and obtaining a "family farm" designation for property from the Minnesota Department of Agriculture. When disputes arise regarding eligibility determinations under the greenacres statute, Maslon has successfully represented clients in actions against county assessors' offices. We also advise clients with regard to the creation of "agricultural preserves" to qualify certain rural and agricultural property for tax deferment benefits and avoid "recapture" taxes that may otherwise be due when property is removed from greenacres status.
