Maslon represents clients in a variety of legal matters involving environmental issues. We have represented clients in matters involving CERCLA, RCRA, CWA and MERLA. Matters range from large Superfund sites to private party cost recovery actions. Our lawyers have experience working and negotiating with regulatory agency personnel over responsive actions, agreements and pluralities. Allocation issues, compliance with the National Contingency Plan, cost recovery and other issues have been litigated by Maslon lawyers. We also bring strong litigation and trial skills to bear on environmental matters. Our lawyers have skills beyond merely understanding the environmental laws which relate to the particular action.

Maslon provides advice and assistance to clients encountering environmental issues in transactions. We help clients arrange for Phase I and Phase II environmental reports conducted in accordance with ASTM standards, and reviews Phase I and Phase II environmental reports for potential environmental issues that may affect purchasers, sellers and lenders. We negotiate and draft appropriate environmental provisions in agreements that provide protections for clients consistent with the risks the client is willing to accept.
