Mark is an of counsel attorney in Maslon's Litigation Group. He represents clients in a wide range of product liability and mass tort litigation. Mark's litigated cases include airplane crashes, natural gas explosions, asbestos injuries, steam distribution systems, cardiac pacing leads, and many other products or accidents. Several of Mark's cases have involved accidents investigated by the National Transportation Safety Board. Included in Mark's litigation practice are environmental matters and Federal False Claims Act matters. Mark also represents insureds in disputes with their insurance companies. Mark has represented Fortune 100 companies to small family-owned businesses in disputes over insurance coverage for property damage, general liability and a variety of defense and indemnity issues.

  • Paulson et al. v. 3M Company, C2-04-6309 (Washington County District Court, Minnesota). Defeated motion seeking class certification of a 67,000 member putative class claiming chemical exposure via drinking water contamination (2007) and obtained a defense verdict on the merits after a seven-week jury trial (2009).
  • Mozes v. Medtronic, 14 F. Supp. 2d 1124 (D. Minn. 1998)
  • In re Minnesota Asbestos Litigation, 552 N.W.2d 242 (Minn. 1996)
  • Independent School District 622 v. Keene Corporation, 511 N.W.2d 728 (Minn. 1994)
  • Graves v. McConnell et al., Minnesota Court of Appeals, unreported, case regarding the liability of co-employees for workplace injuries.
  • In re Diet Drugs (Phentermine, Fenfluramine, Dexfenfluramine) Products Liability Litigation, MDL 1203 (E.D. Pa.). Served as local counsel for multiple injury claims. Reviewed and evaluated claimed injuries as part of MDL.
  • In re Latex Gloves Product Liability Litigation, MDL No. 1148 (E.D. Pa.). Served as local counsel for multiple injury claims. Participated in discovery of latex injury claims for matters remanded from MDL.
  • In re Phenylpropanolamine (PPA) Products Liability Litigation, MDL No. 1407 (W.D. Wash.). Served as local counsel for multiple injury claims. Reviewed and evaluated claimed injuries as part of MDL. Worked with plaintiff's counsel to cure deficiencies in information provided so that injuries could be evaluated.
