  <description><![CDATA[<p>Lawyers and clients in Minnesota and beyond turn to Maslon&#39;s Appellate Group to preserve their trial court victories or to persuade an appeals court of the trial court&#39;s error. Our attorneys have earned a place among leading practitioners as the &quot;go-to&quot; lawyers for complex and challenging appeals in the Minnesota appellate courts, the Eighth Circuit Court of Appeals, and other appellate courts around the country including the United States Supreme Court. Continuing that legacy, Erica Holzer, partner and appellate practice group co-chair, co-authors the leading treatise on Minnesota appellate law and authors a chapter in the Eighth Circuit Appellate Practice Manual.    <title><![CDATA[Steve Schleicher Named Vice Chair of the American College of Trial Lawyers Minnesota Chapter]]></title>
   <description><![CDATA[<p><strong>Steve Schleicher</strong>, partner and chair of Maslon&rsquo;s Investigations &amp; White Collar Defense Group, has been named vice chair of the American College of Trial Lawyers (ACTL) Minnesota chapter. He was inducted as a fellow of the group in 2023.</p>

<p>The ACTL is an invitation-only fellowship that strives to preserve and enhance trial practice, civility, professionalism, and the administration of justice through support of an independent judiciary, the rule of law, trial by jury, and access to justice.</p>

<p>Steve is a renowned trial lawyer with deep experience in high profile cases. He concentrates his work on high stakes criminal and civil litigation, government and internal investigations, and appellate practice. In his white collar criminal defense practice, Steve represents individuals accused of financial crimes involving health care, agriculture, and corporate embezzlement. As a business litigator, he represented Polaroid in a $300 million breach of contract dispute, ultimately securing a complete defense verdict following a two-week jury trial in February 2024. His investigations practice has included a high-profile investigation of a private security company holding a contract at a major NFL venue that resulted in its termination; a data security breach and IP theft conspiracy at a major automobile manufacturer; and internal investigations and government compliance on behalf of health care providers.</p>

<p>In 2021, Steve served as pro bono special prosecutor in the internationally televised homicide trial of former Minneapolis police officer Derek Chauvin for the murder of George Floyd.</p>

   <description><![CDATA[<p>Maslon is pleased to announce the return of Partner <strong>Anna Petosky</strong> to the firm&rsquo;s Litigation Group. Anna brings extensive experience representing both plaintiffs and defendants in a wide range of commercial cases. She focuses her practice on tort &amp; product liability, high-stakes civil litigation, complex business disputes, and investigations.</p>

<p>After working in private practice for more than a decade, including as a Maslon partner, Anna dedicated several years to public service as a prosecutor in the Hennepin County Attorney&#39;s Office in Minneapolis. In that role, she managed a dynamic caseload that included homicide, sexual assault, financial crimes, and drug and property cases through all stages of prosecution. She developed strong first-chair trial skills as she brought numerous violent felonies to jury verdict. She subsequently managed litigation in house as senior legal counsel for a large pharmacy benefit manager, where she oversaw a complex portfolio of litigation, arbitration, regulatory matters, internal investigations, and pre-litigation commercial disputes.</p>

<p>Anna earned her law degree <em>cum laude</em> from the University of St. Thomas School of Law after graduating <em>summa cum laude</em> from the University of Minnesota &ndash; Twin Cities with a B.A. in English and journalism.</p>

   <description><![CDATA[<p>Maslon&nbsp;is pleased to announce the addition of attorney <strong>Annika Misurya</strong> to the firm&rsquo;s Litigation Group.</p>

<p>Annika represents clients in complex civil litigation, white-collar criminal defense, tort and product liability defense, and general commercial litigation. She brings significant courtroom experience, including key roles in six trials over the last two years in both civil and criminal cases.</p>

<p>Annika&#39;s dedication to the profession and the community is evident in her many activities. She has taken on leadership roles with Minnesota Women Lawyers and the Women&#39;s White Collar Defense Association, and she volunteers with the Minneapolis Reader/Writer program, among other roles. Annika is also engaged in pro bono work through the Pro Se Project and the Tubman Safety Project. Through her work with the former, she was recently able to assist an incarcerated individual in achieving a settlement related to excessive force they experienced at the hands of correctional officers.</p>

<p>While attending the University of Minnesota Law School, Annika served as a law clerk in the Hennepin County Public Defender&#39;s office. She also participated in the National Moot Court Competition Team, served as the mentorship program coordinator for the Well-Being Initiative, and volunteered with the Asylum Law Project.</p>

   <title><![CDATA[Erica Holzer and Jevon Bindman Named 2024 Attorneys of the Year for Pro Bono Win on Behalf of Same-Sex Parents in Paternity Suit]]></title>
   <description><![CDATA[<p>Maslon is pleased and proud to announce that attorneys <strong>Erica Holzer</strong> and <strong>Jevon Bindman</strong> have been named 2024 Attorneys of the Year for pro bono work by <em>Minnesota Lawyer</em>. Erica and Jevon were recognized for their successful representation of a married same-sex couple whose child&#39;s sperm donor sued for paternity.</p>

<p>In 2017, William Edrington agreed to be a sperm donor for Julianna and Catherine Sheridan. He filed a paternity petition in March 2023, when the girl was 4, requesting joint legal and physical custody. He amended that petition to request an order to compel genetic testing to establish his biological paternity.</p>

<p>In April 2023, the Sheridans moved to dismiss Edrington&rsquo;s paternity action due to lack of standing. The district court denied the motion. Erica and Jevon represented the Sheridans on the appeal of that denial.</p>

<p>The Minnesota Court of Appeals sided with the Sheridans in an August 2024 ruling, concluding that the Ramsey County District Court wrongly denied their motion to dismiss and that the sperm donor was precluded from bringing a paternity action for their child under Minnesota law.</p>

<p>The decision clarifies statutes impacting parents who use sperm and egg donors to create their families. Most important, the decision strengthens the fabric of every family that has chosen to conceive a child through assisted reproduction&mdash;a ruling of particular significance to the LGBTQ community, who have historically fought for the legitimacy of their families.</p>

<p>Erica is a Maslon partner and co-chair of the Appellate Group who represents clients in complex commercial disputes primarily in the areas of tort and product liability, consumer fraud, business torts, insurance coverage, and breach of contract actions.</p>

<p>She has argued before state and federal appellate courts and has authored, co-authored, and edited dozens of appellate briefs. She is frequently sought out to provide advice on appeals in the Eighth Circuit and the appellate courts of Minnesota, and she has co-authored several leading treatises on Minnesota law and procedure.</p>

<p>Jevon is a Maslon partner who works with clients in a range of industries, with a focus on assisting policyholders in insurance coverage disputes and representing stakeholders in construction and real estate matters, as well as appeals. He appears frequently before Minnesota and federal appellate courts.</p>

<p>Jevon has also established himself as a thought leader in the Minnesota legal community. He co-authors four volumes of the Minnesota Practice Series&mdash;the seminal treatise on Minnesota law and procedure&mdash;including the <em>Minnesota Handbook of Courtroom Evidence</em> and <em>Civil Rules Annotated</em>. Jevon is a member of the Minnesota Supreme Court Advisory Committee on the Rules of Civil Procedure, and he is active as a speaker on court rules, appellate practice, and insurance coverage.</p>

   <title><![CDATA[Minnesota Court of Appeals Orders Dismissal of Paternity Action Brought by Sperm Donor Against Same-Sex Couple]]></title>
   <description><![CDATA[<p>The Minnesota Court of Appeals ruled Monday that the Ramsey County District Court should have dismissed a paternity action brought against a same-sex married couple by their sperm donor.</p>

<p>In its <a href="https://mn.gov/law-library-stat/archive/ctapun/2024/OPa231782-081224.pdf">opinion</a>, the appellate court sided with mothers Julianna and Catherine Sheridan, concluding that the lower court wrongly denied their motion to dismiss and that the sperm donor was precluded from bringing a paternity action for their child under Minnesota law. The Sheridans were represented in the appellate case by Erica Holzer and Jevon Bindman of Maslon.</p>

<p>In August 2017, Christopher Edrington agreed to be a sperm donor for the Sheridans. Following a successful at-home insemination, Julianna Sheridan gave birth to their daughter in July 2018. Julianna and Catherine Sheridan were the only individuals listed on their daughter&rsquo;s birth certificate and together raised her in their St. Paul home.</p>

<p>The Sheridans agreed that Edrington could take part in their daughter&rsquo;s life but became concerned in June 2022 when he began referring to her as his daughter, despite their requests that he refrain from doing so. Edrington filed a paternity petition in March 2023, requesting joint legal and physical custody. He eventually amended that petition to request an order to compel genetic testing to establish his biological paternity.</p>

<p>In April 2023, the Sheridans moved to dismiss Edrington&rsquo;s paternity action. The district court denied the motion, concluding that (1) Julianna Sheridan and the Sheridans&rsquo; daughter were required to submit to genetic testing to establish Edrington&rsquo;s biological paternity; (2) Minn. Stat. &sect; 257.62, subd. 5(c)&mdash;which was drafted to prevent such actions by sperm and egg donors&mdash;did not apply; and (3)&nbsp;Edrington had standing to bring his paternity action because he had welcomed the Sheridans&rsquo; daughter into his home and referred to her as his daughter.</p>

<p>In its opinion, the Minnesota Court of Appeals concluded that the district court wrongly ordered Julianna Sheridan and her daughter to submit to genetic testing, confirming that Minnesota law prohibits sperm donors from using genetic testing to claim parentage over a child conceived through assisted reproduction using their donated gametes. The Court further concluded that the nature of Edrington&rsquo;s relationship and time spent with the Sheridans&rsquo; daughter did not give him standing to assert paternity rights. The court therefore ordered that Edrington&rsquo;s paternity action be dismissed with prejudice.</p>

<p>&quot;Today&rsquo;s decision strengthens the fabric of every family that has chosen to conceive a child through assisted reproduction,&quot; said Maslon Partner Erica Holzer, lead appellate counsel on behalf of the Sheridans. &quot;No parent who has taken the courageous step to use a sperm donor should ever have to fight for the legitimacy of their family.&quot;</p>

<p>&quot;For the legal community, today&rsquo;s decision is precedential in that it clarifies statutes impacting parents that use sperm and egg donors to create their families,&quot; added Mary Pat Byrn of Viitala Byrn &amp; Ives PC, who represented the Sheridans in the underlying litigation.</p>

   <description><![CDATA[<p><strong>Julian Zebot</strong>, Maslon board member, litigation partner, and chair of the Trust and Estate Litigation Group, will serve as program chair and panelist in a presentation on privileges and immunities May 9 at the American Bar Association Real Property, Trust, and Estate (RPTE) National CLE Conference. In the presentation, titled &quot;Think It&#39;s Privileged? Think Again: Managing the Scope of Privilege from Planning to Litigation,&quot; Julian and his fellow panelists will address the many nuances of privilege, work product, and other immunities from discovery within the estate planning and litigation contexts.</p>

<p>Julian focuses his legal practice on probate, fiduciary, and trust litigation as well as business and commercial litigation. <p>Julian also serves as vice chair of the American Bar Association Real Property, Trust and Estate Law Section Litigation, Ethics and Malpractice Group; and as immediate past president of the National Academy of Elder Law Attorneys&ndash;Minnesota Chapter. He was named a fellow in American College of Trust and Estate Counsel in 2020 and serves on several committees for the organization.    <title><![CDATA[Erica Holzer Chairs 2023 Civil Litigator's Annual Update Seminar for Minnesota CLE; Jevon Bindman and Jeremy Krahn Present Session]]></title>

<p>Erica represents clients in complex commercial disputes primarily in the areas of tort and product liability, business torts, insurance coverage, and breach of contract actions. She is also an experienced appellate attorney. Erica currently serves as reporter for three Minnesota Supreme Court Advisory Committees: the Rules of Civil Procedure, the Rules of Civil Appellate Procedure, and the General Rules of Practice; and she is the former chair of the Minnesota State Bar Association&#39;s Appellate Practice Section.</p>

<p>Jevon is an experienced trial lawyer who regularly handles appeals in the Eighth Circuit and Minnesota appellate courts. He is a member of the Minnesota Supreme Court Advisory Committees on the Rules of Evidence and the Rules of Civil Procedure, and is an associate fellow of the Construction Lawyers Society of America. Jevon also writes and presents on issues ranging from trial evidence to construction and insurance coverage law, and he is active as a speaker on the rules governing federal and Minnesota state courts.</p>

<p>Jeremy&nbsp;focuses his practice on product liability defense, complex commercial disputes, and corporate trust litigation. He assists clients in navigating all aspects of civil litigation, from inception through appeals, with particular experience in managing the discovery process. He represents both Fortune 500 companies and small businesses, and he is committed to developing a litigation strategy that best suits the needs of each.&nbsp;</p>

   <title><![CDATA[Steve Schleicher Admitted to American College of Trial Lawyers]]></title>
   <description><![CDATA[<p>Litigation Partner <strong>Steve Schleicher</strong> has become a fellow of the American College of Trial Lawyers, one of the premier legal associations in North America.</p>

<p>Schleicher&rsquo;s induction ceremony took place Feb. 25 during the spring meeting of the College in Key Biscayne, Florida.</p>

<p>Founded in 1950, the American College of Trial Lawyers is composed of the best of the trial bar from the United States, Canada and Puerto Rico. Fellowship in the group is extended by invitation only and only after careful investigation, to those experienced trial lawyers of diverse backgrounds, who have mastered the art of advocacy and whose professional careers have been marked by the highest standards of ethical conduct, professionalism, civility and collegiality. Lawyers must have a minimum of 15 years trial experience before they can be considered for fellowship.</p>

<p>Schleicher, a former federal prosecutor and renowned trial lawyer, is the chair of Maslon&#39;s Investigations &amp; White Collar Defense Group, where he concentrates on high stakes criminal and civil litigation, government and internal investigations, and appellate practice. He is experienced in high profile cases and was widely recognized for his role as a special prosecutor in the internationally televised homicide trial of former Minneapolis police officer Derek Chauvin for the murder of George Floyd and for his work prosecuting the man responsible for the kidnapping and murder of 11-year-old Jacob Wetterling.</p>

<p>Membership in the American College of Trial Lawyers cannot exceed 1% of the total lawyer population of any state or province. The college maintains and seeks to improve the standards of trial practice, professionalism, ethics, and the administration of justice through education and public statements on independence of the judiciary, trial by jury, respect for the rule of law, access to justice, and fair and just representation of all parties to legal proceedings. The college is thus able to speak with a balanced voice on important issues affecting the legal profession and the administration of justice.</p>

<p>Commenting on his induction, Schleicher said, &ldquo;I am honored and humbled to be selected as a fellow in the American College of Trial Lawyers and will continuously strive to reflect its ideals and values inside and outside of the courtroom.&rdquo;</p>

   <title><![CDATA[Jevon Bindman and Erica Holzer Present at the 2023 Appellate Practice Institute for Minnesota CLE]]></title>
   <description><![CDATA[<p><strong>Jevon Bindman</strong> and <strong>Erica Holzer</strong>, litigation partners at Maslon, will present a session Feb. 24 at the 2023 Appellate Practice Institute for Minnesota CLE. The session, moderated by Jevon and featuring Erica as a panelist, will explore the benefits of maintaining a generalist practice to help build trial and appellate skills, which are essential for any civil litigator but are becoming more difficult to develop due to lawyer specialization and fewer opportunities. The session is adapted from an article co-authored by Jevon and Minnesota Supreme Court Justice G. Barry Anderson, which appeared in <em>Bench &amp;&nbsp;Bar of Minnesota</em> in December 2022. Justice Anderson will also serve as a panelist.</p>

The book, Vol. 11A in the Minnesota Practice Series, is published by Thomson West.</p>

   <description><![CDATA[<p><strong>Julian Zebot</strong>, partner in Maslon&#39;s Litigation Group and chair of Maslon&#39;s Trust and Estate Litigation Group, will serve as a co-presenter Dec. 11 at the American College of Trust and Estate Counsel Great Lakes Regional Meeting in Chicago. Julian will discuss ethical issues and risk management in the virtual work environment.</p>

<p><strong>Julian</strong> focuses his legal practice on probate, fiduciary, and trust litigation as well as business and commercial litigation. A Fellow with the American College of Trust and Estate Counsel (ACTEC), he has counseled and represented individual and business clients in both federal and state courts as well as arbitration proceedings, and he has handled matters for clients at all stages of the litigation process, including mediation, trials, and appeals.</p>

<p>Julian&#39;s practice has involved many different types of contested estate, trust, probate, and elder law matters, including will/trust contests (including claims of undue influence and diminished capacity), construction/interpretation disputes, accounting actions, breach of fiduciary duty claims, fiduciary removal actions, trust instruction proceedings, financial elder abuse claims, and creditor claims against estates. When not litigating and resolving disputes, he is a frequent author and speaker on topics relating to probate, fiduciary, and trust litigation; fiduciary risk management; and professional ethics. Among other board and bar committee responsibilities, he is president-elect of the National Academy of Elder Law Attorneys Minnesota chapter and serves as co-chair of the Ethics and Malpractice Committee of the ABA&#39;s Real Property Trust and Estate Law Section.</p>
