<p>Annika represents clients in complex civil litigation, white-collar criminal defense, tort and product liability defense, and general commercial litigation. She brings significant courtroom experience, including key roles in six trials over the last two years in both civil and criminal cases.</p>

<p>Annika&#39;s dedication to the profession and the community is evident in her many activities. She has taken on leadership roles with Minnesota Women Lawyers and the Women&#39;s White Collar Defense Association, and she volunteers with the Minneapolis Reader/Writer program, among other roles. Annika is also engaged in pro bono work through the Pro Se Project and the Tubman Safety Project. Through her work with the former, she was recently able to assist an incarcerated individual in achieving a settlement related to excessive force they experienced at the hands of correctional officers.</p>

<p>While attending the University of Minnesota Law School, Annika served as a law clerk in the Hennepin County Public Defender&#39;s office. She also participated in the National Moot Court Competition Team, served as the mentorship program coordinator for the Well-Being Initiative, and volunteered with the Asylum Law Project.</p>

   <title><![CDATA[Business Owners Quick Reference - Property Insurance]]></title>
   <description><![CDATA[<p><strong>PROPERTY DAMAGE OR LOSS: What steps should I take?</strong></p>

<p><strong>Protect life and property. </strong>It is important to notify the insurance company and get it involved as soon as reasonably possible, but when in doubt, take all reasonable measures to protect life and property. Most insurance policies will require and allow for this expressly. The law requires policyholders to do what they can, within reason, to mitigate damage.</p>

<p><strong>Gather your insurance policies. </strong>Once you think you may have a basis to seek insurance coverage (i.e., your business experiences property damage or business interruption), gather up your complete insurance policy. If you don&rsquo;t have your policy (many policyholders do not), you can request your full policy from your insurance broker or the insurance company itself.</p>

<p><strong>Give initial notice. </strong>As soon as reasonably possible, give notice to your insurance company that you or your business has experienced an event for which you&rsquo;re seeking coverage. Often, your insurance policy will have specific direction about how and to whom notice should be given, such as a phone number, email address, or mailing address. You can also advise your insurance agent, who will often help with this process.</p>

<p><strong>How do I give notice and what should it include? </strong>Your initial notice does not need to be lengthy or detailed. It should explain who you are, identify your policy number if you have it, and inform the insurance company that you&rsquo;ve experienced an event (e.g., property damage) for which you are seeking all available insurance coverage and assistance. Once initial notice is given, an insurance adjuster will likely make contact with you and request more information.</p>

<p><strong>Document as much as possible.</strong> Do everything you can to document all of the damage experienced. Capture videos and photographs if safe to do so. If possible, and especially if damaged property is valuable, preserve damaged property so that the insurance company can inspect and examine it.</p>

<p><strong>Record expenses and keep receipts.</strong> Record all of the expenses you incur as a result of the event. Keep all receipts if possible. It is a good idea to start a spreadsheet early on to record all of your expenses and losses, including name of vendor, amount, form of payment, and date of expense.</p>

<p><strong>Identify consent provisions.</strong> Once time permits, identify any express consent provisions in the insurance policy. In other words, the policy might say that the insurance company will only pay for a certain category of expense if the insurance company agrees to the expense in advance. An insurance coverage lawyer can help you with this, and the insurance adjuster should also identify these provisions for you. When in doubt, to minimize and mitigate your damages, try to get your insurance company&rsquo;s approval before you make repairs or incur expenses.</p>

<p><strong>WHAT KINDS OF COVERAGE DO I HAVE?</strong></p>

<p>The coverage you have depends on the terms of your insurance policy. Generally, &quot;property&quot; policies will include the following and provide broader coverage than coverage for the cost to repair or replace damaged property:</p>

<p><strong>Property Coverage. </strong>Your policy will provide some form of coverage for damage to your premises and define what kinds of perils are covered. Some policies provide &quot;all-risk&quot; coverage; others identify the specific perils covered. Personal property should also be covered. The policy will set out in detail the specific form of coverage, whether there is coverage for replacement costs or actual cash value, and how the valuation works.</p>

<p><strong>Business Income Loss Coverage. </strong>Most policies will include some form of benefits for the lost income resulting from the interruption. This coverage is designed to put your business in the financial position it would have been in had there been no interruption.</p>

<p><strong>Extra Expense Coverage.</strong> Most policies will include coverage for &quot;extra expense,&quot; which is often defined as the non-ordinary expenses your business incurs to mitigate losses and continue to offer your product(s) or services during the down time. For example, the cost to rent space to continue business operations while your primary space is shut down or repaired should be covered.</p>

<p><strong>Other Miscellaneous Coverages.</strong> Property policies often include other coverages with sub-limits, such as debris removal, that may be overlooked. An insurance coverage lawyer can help you carefully review your policy and identify these kinds of coverages to help you maximize your recovery.</p>

<p><strong>WHAT WILL HAPPEN AFTER I GIVE NOTICE AND HOW DO I PRESENT A CLAIM?</strong></p>

<p><strong>Assignment of an insurance adjuster. </strong>After you give notice to your agent or the insurance company, the insurance company will usually appoint an insurance adjuster promptly. This person&rsquo;s job is to investigate the loss, value the loss, and determine for the insurance company what is covered.</p>

<p><strong>Should I trust the adjuster? </strong>Many policyholders wonder, &quot;Can I trust the adjuster?&quot; You should cooperate with the adjuster, but also understand that the adjuster represents the insurance company, which has a financial incentive to save money and minimize coverage. Many adjusters are doing their best to process claims, but you should not view the insurance adjuster as your advocate or someone who has a duty to look out for your interests. If you have issues or problems with your adjuster, contact an insurance coverage lawyer for help.</p>

<p><strong>What is a proof of loss?</strong> Most property policies provide a &quot;proof of loss&quot; process through which the policyholder presents its claim for benefits to the insurance company. The policy often includes guidelines about what the proof of loss should include, and some companies have a specific form they provide for completion. Policies also often include a specific timeframe for submission of the proof of loss, though this can often be negotiated if more time is needed. As part of the proof of loss, the policyholder submits the detail and documentation of its losses.</p>

<p><strong>DENIAL OF COVERAGE</strong></p>

<p>Insurance companies often aggressively deny coverage initially and benefit, in the aggregate, from policyholders who walk away from coverage. Many states&#39; laws are set up to favor the policyholder and try to correct the power imbalance between insurance companies and policyholders.</p>

<p><strong>How should I respond to a denial of coverage?</strong> If you receive a denial of coverage, contact an insurance coverage lawyer for advice on your rights and options for pursuing insurance recovery. The legal expense is relatively modest, and the minimal work to review and contest a denial of coverage can deliver substantial value to your bottom line.</p>

<p><strong>Should I consider litigation against my insurance company? </strong>When necessary, coverage litigation can be an effective and efficient way to protect your rights. And depending on applicable state law, policyholders have strong remedies available to them, including the right to recover attorneys&#39; fees, substantial prejudgment interest at double-digit rates, bad-faith penalties, consequential damages, punitive damages, and more.</p>

<p><strong>What is the risk of waiting to give notice?</strong> Many kinds of liability insurance are provided on a &quot;claims-made&quot; basis, requiring: 1) a &quot;claim&quot; to have been made during the policy period or extended reporting period; and 2) notice of the &quot;claim&quot; to be given by the policyholder within a specified time&mdash;often no later than the end of the policy period. Failure to give timely notice can lead to the insurance company denying all coverage. Each year, policyholders nationwide incur the significant costs and aggravation of fighting for coverage put at risk by late-notice defenses.</p>

<p><strong>What is a &quot;claim&quot;?</strong> The term &quot;claim&quot; is commonly defined as &quot;a written demand for monetary or non-monetary relief.&quot; But some courts have interpreted &quot;claim&quot; to include any third-party assertion that a policyholder may be liable for damages. Thus, waiting for a lawsuit to be filed to give notice can be too late.</p>

<p><strong>How can I be proactive about identifying possible claims?</strong> Train key employees to recognize issues that could give rise to a claim or lawsuit. Empowering your team can help ensure that notice requirements and coverage are assessed at the earliest stages of a matter.</p>

<p><strong>How do I provide notice?</strong> Notice can be handled by your insurance broker, risk manager, or outside counsel. It is important to follow the directions in the policy as to how and where to deliver the notice. Simply attach the related claim (i.e., demand letter) or complaint to your notice along with a letter to your insurance company seeking all available coverage, including defense coverage, under all applicable policies. Recommended best practice is to notify all potentially applicable excess and umbrella carriers at the same time as your primary, first-level insurance company.</p>

<p><strong>Beware of privilege issues. </strong>Many policyholders initially contact their insurance broker when faced with a claim. But keep in mind that broker communications may not be protected by the attorney-client privilege.</p>

<p><strong>UNDERSTANDING YOUR POLICIES</strong></p>

<p><strong>What is the scope of my insurance coverage?</strong> Understanding the substance of your policies early on will help you communicate with your insurance company in a way that protects your interests. It will also help you set expectations regarding potential recovery and defense protection. Ensure that you are informed on these key issues:</p>

<ul>
	<li>the operative insuring agreement(s);</li>
	<li>the policy limits and how they apply;</li>
	<li>applicable deductibles or self-insured retentions;</li>
	<li>the type of defense coverage provided;</li>
	<li>potentially applicable exclusions;</li>
	<li>any contractual limitations period that might limit the time to take legal action;</li>
	<li>cooperation, consent, and subrogation provisions; and</li>
	<li>claim reporting and notice provisions and deadlines.</li>
</ul>

<p><strong>What are the common oversights?</strong> Businesses often overlook insurance protection and assume coverage is limited to certain policies (i.e., a CGL policy). When faced with a potential claim or suit, it is important to thoroughly review your insurance program for potential coverage. For example:</p>

<p><strong>Prior policies: </strong>Don&rsquo;t assume your current policy is the only one that might apply. For insurance policies written on an &quot;occurrence&quot; basis, providing notice under prior policies to historical insurance companies can be imperative. Sometimes coverage should be requested under both claims-made and occurrence-based policies.</p>

<p><strong>D&amp;O insurance:</strong> Remember that this is not only for directors and officers. Many D&amp;O policies are written with broad &quot;C-side&quot; coverage for claims against the business and are packaged with coverage for employment liability, fiduciary liability, crime risks, cyber risks, and more.</p>

<p><strong>Coverage for regulatory matters:</strong> Don&rsquo;t forget to provide early notice for regulatory matters. A regulatory investigative demand or subpoena that precedes a formal enforcement action may constitute a &quot;claim&quot; under your policy and could trigger coverage for attorneys&#39; fees and costs.</p>

<p><strong>RESERVATION OF RIGHTS</strong></p>

<p>A reservation of rights letter is a communication from an insurance company providing notice to the policyholder that a claim may not be covered. The letter can be confusing, but it often communicates that the insurance company will provide a defense for the time being while it continues to evaluate coverage. It could be a signal that the insurance company is going to take positions contrary to your interests. When considering whether or how to respond, involve an insurance coverage lawyer to position yourself for the best possible outcome should litigation occur.</p>

<p><strong>CHOICE OF DEFENSE COUNSEL</strong></p>

<p><strong>Does my insurance company have the right to choose my defense lawyer if it agrees to cover my defense? </strong>It depends. Insurance companies providing defense coverage often want to dictate selection of the policyholder&#39;s lawyer. Insurance companies may want to control defense-lawyer selection because they have pre-existing &quot;panel counsel&quot; relationships with law firms, which agree to work at discounted rates based on volume. But an insurance company&#39;s presumptive right to select defense counsel in connection with a &quot;duty to defend&quot; is not a hard and fast rule. Do not assume you do not have a choice.</p>

<p><strong>What are my options for choosing my own defense lawyer? </strong>Policyholders should understand and assert their rights before acquiescing to the insurance company&#39;s control. A panel lawyer may have divided interests because of a financial interest in future work and may not be the best lawyer for the job. Where there is a potential conflict of interest between the insurance company and the policyholder because, for example, the insurance company asserts that some of the claims against the policyholder are not covered, the policyholder may have the right to select counsel.</p>

<p><strong>DENIAL OF COVERAGE</strong></p>

<p>Insurance companies often aggressively deny coverage initially and benefit, in the aggregate, from policyholders who walk away from coverage. Many states&#39; laws are set up to favor the policyholder and try to correct the power imbalance between insurance companies and policyholders.</p>

<p><strong>How should I respond to a denial of coverage? </strong>If you receive a denial of coverage, contact an insurance coverage lawyer for advice on your rights and options for pursuing insurance recovery. The legal expense is relatively modest, and the minimal work to review and contest a denial of coverage can deliver substantial value to your bottom line.</p>

<p><strong>Should I consider litigation against my insurance company?</strong> When necessary, coverage litigation can be an effective and efficient way to protect your rights. Depending on applicable state law, policyholders have strong remedies available to them, including the right to recover attorneys&#39; fees, substantial prejudgment interest at double-digit rates, bad-faith penalties, consequential damages, punitive damages, and more.</p>

   <title><![CDATA[David Suchar Elected Fellow of the American College of Construction Lawyers]]></title>
   <description><![CDATA[<p>Maslon&nbsp;is pleased to announce that <strong>David Suchar</strong>, partner, firm vice-chair, and chair of the Construction &amp; Real Estate Litigation Group, has been elected Fellow of the American College of Construction Lawyers (ACCL). The prestigious, invitation-only organization is made up of construction law practitioners, professors, and judges.</p>

<p>ACCL fellowship is extended to those who are found to have mastered the practice or the teaching of construction law and dispute resolution in the complex technical and legal fields pertaining to the built environment, whose professional careers have been marked by the highest standards of ethical conduct, scholarship, professionalism, and collegiality, and who have demonstrated a commitment to &ldquo;give back&rdquo; to the construction industry. Fewer than 240 other attorneys from the U.S., Canada, Britain, Australia, and France are Fellows in the organization.</p>

<p>Membership in the college is by invitation only upon nomination and election. Prospective members must be proposed for membership by a Fellow in good standing, seconded by at least two other Fellows who have personal knowledge of the nominee, and nominated by the Membership Committee. Their election by the Board of Governors is then ratified by the entire membership. To be eligible for election into the college, a lawyer must be admitted to practice law before the highest court of his or her respective state, territory, or country and have been actively and continuously engaged in the full time practice or teaching of law for a combined total of at least 15 years.</p>

<p>A trial attorney and former federal prosecutor, David&nbsp;has built a broad construction law practice. He negotiates and litigates significant construction negligence, lien, and payment disputes throughout the Midwest and has one of the top insurance coverage for construction practices in the country.</p>

<p>For example, in 2020, David&nbsp;settled claims brought against a large international structural engineering firm related to the $1.1 billion U.S. Bank Stadium Project&mdash;the largest construction project in Minnesota history. His niche national practice representing commercial policyholders in insurance coverage disputes has included many of the largest construction projects and claims across the United States. Recent matters include the LaGuardia Airport Central Terminal Reconstruction Project (NYC); Apple Campus (Cupertino, CA); Las Vegas Raiders (Allegiant) Stadium; SeaTac Airport; Long Beach International Gateway (Gerald Desmond) Bridge; Second Avenue Subway (NYC); claims on Millennium Tower, Transbay Transit Center, and Salesforce Tower (San Francisco); and the Florida International University bridge collapse (Miami).</p>

During the session, which is in-person and available on Zoom, Jevon and his co-presenters will describe the AGC-MN contracts and how they address new federal and Minnesota laws that impact the construction industry.    <description><![CDATA[<p>Litigation Partner <strong>Steve Schleicher</strong> has become a fellow of the American College of Trial Lawyers, one of the premier legal associations in North America.</p>

<p>Schleicher&rsquo;s induction ceremony took place Feb. 25 during the spring meeting of the College in Key Biscayne, Florida.</p>

<p>Founded in 1950, the American College of Trial Lawyers is composed of the best of the trial bar from the United States, Canada and Puerto Rico. Fellowship in the group is extended by invitation only and only after careful investigation, to those experienced trial lawyers of diverse backgrounds, who have mastered the art of advocacy and whose professional careers have been marked by the highest standards of ethical conduct, professionalism, civility and collegiality. Lawyers must have a minimum of 15 years trial experience before they can be considered for fellowship.</p>

<p>Schleicher, a former federal prosecutor and renowned trial lawyer, is the chair of Maslon&#39;s Investigations &amp; White Collar Defense Group, where he concentrates on high stakes criminal and civil litigation, government and internal investigations, and appellate practice. He is experienced in high profile cases and was widely recognized for his role as a special prosecutor in the internationally televised homicide trial of former Minneapolis police officer Derek Chauvin for the murder of George Floyd and for his work prosecuting the man responsible for the kidnapping and murder of 11-year-old Jacob Wetterling.</p>

<p>Membership in the American College of Trial Lawyers cannot exceed 1% of the total lawyer population of any state or province. The college maintains and seeks to improve the standards of trial practice, professionalism, ethics, and the administration of justice through education and public statements on independence of the judiciary, trial by jury, respect for the rule of law, access to justice, and fair and just representation of all parties to legal proceedings.
