Jason Lien and Evan Nelson Represent BNSF Before the North Dakota Supreme Court

August 22, 2023

Jason Lien, a partner in Maslon's Litigation Group, argued before the North Dakota Supreme Court on Monday on behalf of client BNSF Railway Company opposing an extraordinary writ that sought to stay construction of BNSF’s rail bridge replacement project. BNSF's construction project is being challenged by a historic preservation group in two separate appeals. Jason’s oral argument was quoted in several media reports about the case, noting the railroad "received all the necessary permits" following an extensive five-year project planning process, and that the preservation group’s proposed stay was without merit and would cause great harm to the needed project. Also representing BNSF in the cases before the North Dakota Supreme Court is Maslon attorney Evan Nelson.

Jason focuses his litigation practice on representing clients from the construction, real estate, financial services, food, and railroad industries and has been recognized by Chambers USA for construction law in 2016-2023. Evan specializes in both real estate litigation and trusts and estates disputes. He was named a 2021 Up & Coming Attorney by Minnesota Lawyer, and was selected for inclusion on the 2021-2023 Minnesota Rising Stars lists from Super Lawyers, a designation given to only 2.5% of Minnesota attorneys each year.
