July 1, 2020
David Herr, attorney in Maslon's Litigation Group, has authored the 2020 editions of two publications—the Annotated Manual for Complex Litigation Fourth and the Multidistrict Litigation Manual: Practice before the Judicial Panel on Multidistrict Litigation—both published by Thomson West.
The Annotated Manual for Complex Litigation Fourth provides attorneys and judges with detailed guidance on the management of complex litigation, analyzing cases that construe Federal Judicial Center Manual provisions. It also examines case management techniques including issues of class action, certification, mass torts, and the power of the Panel on Multidistrict Litigation to transfer cases.
The Multidistrict Litigation Manual: Practice before the Judicial Panel on Multidistrict Litigation guides lawyers through practice before the Judicial Panel on Multidistrict Litigation. It covers the increasing role of the panel and provides detailed annotations to the Multidistrict Litigation Statute, 28 U.S.C.A. § 1407. Readers will find reviews of panel decisions, analysis regarding practice before the panel, and information on recent developments.
David is a highly regarded appellate lawyer and complex case litigator. He is frequently sought out to provide practical and sophisticated advice on how to resolve difficult, multi-party disputes in trial courts and arbitral forums as well as in the appellate courts. David is past president of the American Academy of Appellate Lawyers, past president of the Academy of Court Appointed Masters, and regularly argues cases in the Minnesota appellate courts and the Eighth Circuit Court of Appeals.
