Maslon represented a local racetrack and card club in its successful effort to continue offering dealer-assist electronic table games.

Running Aces, a casino, hotel, and racetrack in Columbus, Minnesota, began offering electronic table games at its casino in 2017 after the Minnesota Racing Commission authorized their use. Electronic table games involve a live dealer dealing physical cards at a central table. The cards are shown electronically on the players’ individual player stations, where the players make their decisions according to the rules of the games. A team led by Maslon attorney Bill Mower had prepared detailed letters to the commission supporting the expanded game offerings.

Since then, Maslon has successfully defended Running Aces’ dealer-assist card playing against several challenges. Maslon attorneys Evan Nelson, Erica Holzer, and Carly Johnson argued at the Minnesota Court of Appeals that the electronic table games were, in fact, card games and not video games. The appeals court agreed. In January 2026, the Minnesota Supreme Court affirmed the Court of Appeals decision. A separate challenge, on the same grounds but on another dealer-assist game, was brought to the Court of Appeals, where Maslon attorneys argued the challenge should be rejected for bringing the same arguments that had already been resolved in favor of Running Aces. On Aug. 24, 2026, the Court of Appeals agreed, and affirmed the Minnesota Racing Commission’s approval of the game.
